These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
The Services are only intended for persons over the age of 18 residing in the country for which the Services are available. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
None of the services provided to you by the provider can be considered investment services by applicable laws. None of the services constitutes investment advice or recommendations. No employees, staff or representatives of the provider are authorised to provide any investment advice or recommendations.

The registration fees are paid for allowing you to access the Windlu platform, models and services. The Customer is not entitled to a refund of the registration fees if the service has been started (i.e. started trading on our platform) and/or the Customer did not complete the Evaluation. No refund applies to all that Windlu offers.
General Conditions
We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Online Registration Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
A breach or violation of any of the Terms will result in an immediate termination of your Services.

We make every effort to ensure that the information we provide is accurate, however, the information is also supplied by third parties and we are not responsible if the information made available on this site is not accurate, complete or current. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Service.
Billing and Account Information Accuracy
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. If we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or unauthorised distributors.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
Products or Services (if applicable)
We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Indemnification
You agree to indemnify, defend and hold harmless Windlu and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
Termination
The obligations and liabilities of the parties incurred before the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment, you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
Severability
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
Disputes
Once you dispute an order payment it hurts the company, financially, and causes damage to our company profile in the eyes of the Payment Gateway. Hence, according to our policy, we will be banning accounts (directly involved in the dispute/against the same order number) of traders who dispute their payments and moving forward we will not entertain any requests to unban the accounts(s).
The user who is involved in a disputed transaction in the normal course of the business, where there has not been any problem on our side, such users won’t be eligible for any further accounts with Windlu and all their other active accounts, with a current balance over and above the initial balance, will be refunded as well.
This policy is in place to protect Windlu from any financial adversity as well as to ensure the long-term viability of the brand name.
Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed by the law user’s legal jurisdiction.
Windlu (the “Company”) is incorporated under the laws of South Africa. You have provided services to the Company, including trading execution services, under an Independent Contractor Agreement (the “Agreement”) entered into with the Company. In providing these services, and by the terms of the Agreement, the Company has operated under the understanding that you have and are continuing to act in compliance with the South African laws, as they may apply to you.
If you have any questions concerning any obligations that may apply to you, including under South African securities law, we would encourage you to consult legal counsel.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Refund Policy
All traders have the facility of receiving a full refund for any order they have purchased as long as they have not placed any trades on the respective account(s). Traders can apply for a refund by contacting our Billing Department (billing@windlu.com) and informing them of the matter. After the request has been evaluated for eligibility, they will be notified via email and the refund will be sent back to them within 5-10 business days through the same medium they had paid for the order.
Traders are not entitled to any refund if they have already used our services i.e.: traded on the account(s) received against the order as stated in our Terms of Services.
In case of a legal dispute, all active accounts that are at and/or above the initial balance will be refunded back to the trader apart from the disputed account and the trader will no longer be able to avail the services in the future.
If a customer is found to be underage by the standards of Windlu (under 18) then their order will be refunded immediately.
Customers residing in regions where Windlu does not offer its services to will be refunded.
Windlu does not offer its services to anyone possessing a criminal record or anyone involved in any sort of adverse media presence. The orders of all such individuals will be refunded. This is to lower the company’s risk exposure and to protect Windlu from any adversity.
Windlu holds a neutral stance regarding any political activity and therefore will not allow individuals with any sort of recorded political activity to avail of its services.
Customers that have purchased orders with a stolen credit card will be refunded upon discovery of the act.
Any customer that cannot present acceptable KYC and contractor agreement at the time of verification and/or request of an agent will be refunded.

All the content published and distributed by Windlu (herein referred to as, the ‘Company’) is to be treated as general information only. None of the information provided by the Company or contained herein is intended as (a) an offer or solicitation of an offer to buy or sell, (b) a recommendation, endorsement, or sponsorship of any security, company, or fund, (c) investment advice, (d) any advice of a financial nature or (e) any advice of a personal nature whatsoever. Anti-Money Laundering (AML)
Documents Required from Individuals Opening an Account
By applicable laws, Windlu must verify your identity before allocating company capital to any individuals as a contractor. There are various ways to verify your identity, but we usually confirm a person’s identity with a photo ID and proof of address.
A valid photo ID may either be a (1) passport or (2) government-issued ID, such as a driver’s license. Please ensure that the photo ID shows your full name and date of birth. Any missing information may disqualify you from opening an account with Windlu.
A valid proof of address comes in many forms. The following is a list of documents that are acceptable forms of proof of address:
Lease agreement or mortgage statement
Utility bill
Bank or credit card statement
Government-issued tax document
Record of employment
Note that any of the aforementioned proof of identity documents must be current. Any document that is expired or more than three (3) months old will not be accepted. Additionally, any document with the individual’s name and a P.O. Box address will not be accepted.
However, should you have trouble accessing or having possession of any of the documents listed above, please contact us so we can assist further. We may be able to accept the certificate of citizenship. Documents must be in English. If documents are in another language, Windlu reserves the right to require the document to be translated into English alongside the original document.
Withdrawal of Funds
Windlu adheres to strict guidelines to ensure accurate, efficient and thorough transfer of funds.
Clients must complete a withdrawal request form which will contain the account holder’s information.
All requests must be submitted to the Windlu accounts department for processing. The department will confirm the account balance and that there are no holds or applicable restrictions on the account. Once approved, compliance will also approve.
The accounting department will review all requests and confirm that the original funds are being requested using the same method of deposit and to the correct account holder on file. We examine the request made in conjunction with the client’s deposit history to ensure that there is no suspicious activity. We also verify the bank account on file.
Once reviewed and approved, the withdrawal request will be processed and the funds will be sent to the individual.
In the case that an account is perceived or determined to have suspicious activity, the withdrawal will be placed on hold and will be reviewed internally for further investigation.
Any unauthorized, unlawful, or willful misconduct may require Windlu to involve legal counsel or external authority.
Notice
Windlu performs actions to adhere to applicable laws and regulations. It does not accept cash deposits nor does it disburse cash under any circumstance. Furthermore, Windlu does not accept third-party deposits of any kind. Windlu reserves the right to refuse the processing of a transaction at any stage where it believes that the transaction is or may be associated with unlawful, illegal, or willful misconduct that may lead to money laundering crimes or criminal activity. Should there be suspicion or a determination that the account holder is engaged in criminal activity, Windlu is not obligated to inform the client if suspicious activity is reported to any regulatory or legal body of the government.
Instant Challenges Rules and Guidelines
Instant accounts are available to trade currencies, commodities, indices and Crypto. Leverage for currencies is 1:30, commodities 1:8, indices 1:10 and Crypto 1:1. Lot sizes limitations are in place and vary on each account. The Profit split is 70%. The daily drawdown 4% and the overall drawdown is 6%. Traders can withdraw funds weekly provided they are in profit with R250 and more. The Registration fee is nonrefundable. There are no minimum trading days. All other trading rules are applicable.
Prohibited trading strategies that violate the Windlu rules and Terms of Service
At Windlu, we pride ourselves on having an open and inclusive trading environment for all who abide by our ToS. We value and respect all traders, regardless of the trading style, strategy, or statistical approaches used. However, it must be noted that any form of cheating, fraud, or abuse of the simulated trading environment is unacceptable and violates the Windlu Terms of Use. Such behaviors may result in warnings, account suspensions, or even account termination. Any form of cheating and abuse of the simulated environment is strongly prohibited and goes directly against the Windlu ToS that all traders agree to when signing up for our services. We strongly encourage all members of Windlu to read this article and Windlu’s ToS policy in their entirety to avoid unintended violations.
At Windlu, our primary goal is to empower traders to generate trading date. The essence of our firm is rooted in attempting to collect legitimate, practical trading insights, measured through comprehensive risk factors and metrics, which have the potential of being reproducible to trade under real market conditions by third parties. To assist Windlu in this objective, we have developed a statistical analysis methodology to compare individual traders against the average population of traders in both the challenge and funded phases. We use this methodology, incorporating certain risk factors and various trading metrics, to review trading data, identifying traders whose practices are inconsistent with our objective or otherwise constitute an abuse in our determination of the trading environment in which we operate.
Any account, regardless of the phase, may be subject to an internal statistical review of trading activity, behaviour, patterns and account data at any time. Without limiting the foregoing, funded account payout requests, as well as all associated customer trading and KYC data associated with the relevant account, any accounts for the same or related beneficial trader, and data that is otherwise identified by our data anomaly detection systems are subject to further review. These reviews are performed using metrics designed to identify potential violations of our terms of service, customer agreement or trading practices that are not actionable in live market scenarios. Please reference the article sections below for additional information, emphasising some of the non-actionable trading data scenarios and violations. Based on such reviews, Windlu may in its sole discretion undertake and execute one or more of the following actions:
Challenge disqualification and/or;
Profit deductions and/or;
Issuance of warnings and/or;
Account suspensions and/or;
Payout denials and/or;
Payout delays and/or;
Account termination and/or;
Suspension of services.
If a review indicates with reasonable assurance in Windlu’s sole determination that a violation or prohibited activity has occurred, including but not limited to behavior described as “gambling,” “punting” or “account churning,” Windlu exercises its right to take and implement without prior notice one or more of the firm actions referenced above, in accordance with our customer agreement and Terms of Service.
We remind you of our core mission: facilitating the creation of actionable trading data.
Cheating tactics Is Prohibited
Any trading styles that are deemed as “cheating”, or otherwise not reflective of trading in the real market, are not permitted and will result in a violation of our Terms of Service. For this reason, it is against our rules to take advantage of strategies that generate risk-free, consistent simulated profits only on demo accounts.
Our Funded Traders are expected to be trading on their accounts as if they are live accounts. Any use of a strategy that takes advantage of demo accounts will result in the closure of a Virtual Funded Trader’s account, whether in the evaluation phase or while funded.
Please note that using any account management, “pass your challenge”, and/or copy trading services is also strictly prohibited and will result in the rejection of any Simulated Funded Accounts, as well as a permanent ban of all Windlu’s services.
Examples of Strategies That Violate Windlu’s Trading Rules
Account Sharing or Account Sale
Traders are restricted from the sharing of accounts or the re-sale of Simulated Funded Accounts from one owner to another for any reason.
Account sharing and the selling of accounts are strictly prohibited and will result in the immediate breach of your account(s) and being banned from our services as this behaviour goes against Windlu’s Terms of Service.
Martingale Trading
The Martingale trading strategy is a method of investing in which the size of the investment is increased after each simulated loss, with the expectation that a winning trade will recoup all previous simulated losses and produce a simulated profit. This strategy is considered gambling and is extremely risky as it can lead to large simulated drawdowns and the simulated loss of all simulated capital if a trader experiences a prolonged series of simulated losses.
In theory, this strategy will always work, but in practice, it is only possible to make this strategy work with unlimited simulated capital. Firms provide a pre-determined level of maximum simulated Drawdown and all traders should formulate their strategy around this predefined level of maximum risk.
It is crucial to have a well-defined risk management strategy in place and to avoid betting an entire account on a single trade. Therefore, this trading activity goes against Windlu’s Terms of Service.
Grid (Reverse) Trading
Grid trading is a trading strategy that involves placing inverse buy and sell orders of the same instrument for the exact or similar risk. This strategy can lead to market manipulation, over-leveraging, market instability, and a potential risk-free simulated profit. As members of the Windlu community, it is crucial to have a well-defined risk management strategy in place to avoid large simulated Drawdowns and over-leveraging. Therefore, the use of grid trading is a prohibited trading strategy.

Abuse of the Simulated Environment
Clear abuse of the simulated environment is characterized by continuously executing large-volume trades without a clear or logical trading strategy. This behaviour disregards fundamental market analysis and risk management practices and does not provide us with viable trading data. Accounts engaging in consistent, high-volume trades without a coherent strategy may be flagged for review. This allows us to assess and take appropriate action to maintain a fair trading environment consistent with our mission of obtaining credible trading data.
Accounts identified to be consistently executing large-volume trades without a clear strategy may face warnings, temporary limitations on trading activities or in severe cases, suspension, or termination to uphold the platform’s trading policies.
High-Frequency Trading (HFT)
Usage of HFT bot(s), HFT Expert advisors (EA), and HFT algorithms are strictly prohibited on our platforms and should not be used under any circumstances.
High-Frequency Trading (HFT) refers to the use of advanced computer algorithms and high-speed telecommunications networks to execute large numbers of trades in fractions of a second.
HFT is prohibited as it can lead to market manipulation, unfair advantages, and can cause instability in the market. Any trader found to be engaging in HFT will breach the Windlu’s Terms of Service and lose the ability to trade on our platform. For more specific examples of the type of abuse that HFT can lead to, please see the Trading on Delayed Data Feed and Trading on Delayed Trading Chart sections below.
High-Frequency Trading (HFT) refers to complex algorithmic trading in which large numbers of orders are executed within short time periods.
One form of HFT which is prohibited is Latency Arbitrage. Latency arbitrage is a trading strategy that takes advantage of the time delay between the execution of a trade and the receipt of market data.
Trading in US-Sanctioned Countries
Traders are restricted from logging in and raising orders in OFAC-sanctioned countries.
Collusion Between Users
Collusion between users refers to a trading strategy where an individual or group of individuals open multiple accounts with a financial institution and place trades in the same direction (i.e., buy/sell), on the same asset, across all accounts. Collusion between users is also known as “layering” or “spoofing” and is considered a form of market manipulation.
This type of trading behavior is strongly prohibited and will result in the breaching of all accounts and the banning of the trader.
Hedging or Group Hedging Across Multiple Accounts
Hedging or group hedging across multiple accounts, on the other hand, refers to a trading strategy where an individual or group of individuals open multiple accounts with a financial institution and place trades in opposite directions (i.e., buy/sell), on the same asset, across all accounts.
This can be done in an attempt to simulated profit from the price movements of an asset without having to take on significant market risk.
This type of trading behaviour is also known as “Arbitrage” and “Grid Trading” and is not permitted at Windlu. In the real market, this would result in $0 or R0 simulated profit as you are hedged in both directions.
However, while trading with a Firm, you would be losing the firm money on one account and generating a simulated profit on the other, resulting in risk-free simulated profits, which are violations of compliance with the functioning of the real financial market.
Use of a Delayed Data Feed
The use of a delayed data feed in day trading refers to the practice of using a data feed that has a delay or lag in the delivery of market data, such as stock prices or trading volumes, giving an unfair advantage to the trader over other traders who are required to use real-time market data.
Using a delayed data feed is considered unethical and is not in compliance with the operations of the real financial market. Therefore, this trading behaviour goes against Windlu’s Terms of Service.
Trading on Delayed Charts
Trading on delayed charts refers to the practice of using charts or other graphical representations of market data that have a delay or lag in their updates.
Trading on delayed charts is considered unethical and is not in compliance with the operations of the real financial market. Therefore, this trading behaviour goes against Windlu’s Terms of Service.
Use of guarantee of compliance with limit orders (including take profit and stop loss)
The use of a guarantee of compliance with limit orders, including take profit and stop loss, is prohibited as it can be used to circumvent regulatory restrictions and manipulate the market.
This type of abuse is due to the nature of trading on a simulated platform. However, when using this guarantee of compliance with limit orders, traders may be able to avoid the fills that they would have received in the real market, making this strategy not in compliance with the operations of the real financial market. Therefore, this trading behaviour goes against Windlu’s Terms of Service.
Trading Activity: Soft Breaches/Warnings
The following are examples of trading behaviours and activities that will result in soft breaches and warnings that can escalate to the breach of your accounts and possible ban from our community.
Use of Platform or Data Freezing Due to a Demo Server Error
The use of platform or data freezing due to a demo server error is prohibited as it can lead to unfair advantages and misleads the traders. Traders found to be engaging in this practice will be investigated and may lose the ability to use our demo servers.
Of course, if we have a server issue that causes delays and prohibits you from closing trades for stop simulated loss or take simulated profit, we will see this in our logs and will work with those traders to remedy the situation. We encourage you to take screenshots or screen recordings of any freezing issues you are experiencing so that we may address them with our trading platform provider.

Trading on News Events
News trading is a strategy traders use to take advantage of the market’s reaction to economic or political news and events. This can include things like interest rate decisions, GDP reports, and political announcements. News trading can be risky as the market reaction to news events is often unpredictable and can lead to significant simulated losses.
Therefore, Windlu has certain restrictions for Virtual Funded Accounts only in terms of trading at a time of significant macroeconomic reports and being filled at an unrealistic price due to the volatility of the event.
We therefore do not allow trading News Trading on our virtual funded accounts.
Layering of orders
Order layering refers to a trading strategy wherein customers intentionally split up positions into multiple smaller trades executed around the same time. The primary aim of this strategy is to mitigate simulated market conditions slippage by lowering the “static slippage associated with the size of the order.”
In simulated trading environments, such as those provided by Windlu, order layering can be perceived as advantageous due to the absence of real liquidity consumption. Unlike in live markets, where each order consumes liquidity from the order book, simulated orders do not have a corresponding counterparty, allowing them to be filled repeatedly against the same book without appropriate slippage adjustments.
It is crucial to recognize that order layering constitutes an abusive practice within the simulated trading environment. By repeatedly splitting up positions into smaller trades, traders manipulate the system’s mechanics to their advantage, distorting the intended simulation of real market conditions.
Customers found engaging in this abusive strategy may face disciplinary actions, including but not limited to removal of profits gained from layered orders. Such profits will be deducted from payouts, and if this action causes a breach of any terms of service or trading policies, the customer is held responsible. Upholding these policies ensures the integrity and fairness of our platform’s trading environment for all users.
Conclusion
These are the most common strategies that we have seen people use to take advantage of demo accounts, though this list does not represent all possible strategies that would go against our trading rules. If any account is seen to be using unfair strategies or an unrealistic trading style, they will not be eligible to be funded, and Virtual Funded Accounts may be breached. Keep in mind that all trading on our platform must be in agreement with the real operations of the financial market. Our statistical assessments and reviews continue to be refined as more data is obtained, such that a situation that hypothetically might not have been identified as problematic once, could be flagged in the future.
If a strategy is found not to be replicable in the real market, we reserve the right to investigate this strategy and terminate your access to our services.
